We volgen de status van CBD in de Novel Food Guidelines sinds 2013. Er volgden drie verschillende vermeldingen en een poging van de Europese Commissie om CBD opnieuw in te delen als farmaceutisch product. Er kwam goed nieuws met de uitspraak van het Europees Hof van Justitie in de Kanavape-zaak<\/strong><\/p>\n\n\n\n

In dit artikel geven we je een overzicht van hoe het landschap eruit ziet en wat we denken dat er hierna gaat gebeuren.<\/strong><\/p>\n<\/div>\n<\/div>\n\n\n\n

Wat is \"nieuw voedsel\"?<\/h2>\n\n\n\n

Volgens Verordening (EU) 2015\/2283 worden nieuwe voedingsmiddelen gedefinieerd als \"[levensmiddelen die v\u00f3\u00f3r 15 mei 1997 in de Unie niet in significante mate] voor menselijke voeding zijn gebruikt (...)\".<\/em>. <\/p>\n\n\n\n

Dit betekent dat als een bedrijf een nieuw product op de markt wil brengen, eerst moet worden aangetoond dat het veilig is voor menselijke consumptie. Dit gebeurt via een Novel Food Application bij de EFSA (Europese Autoriteit voor Voedselveiligheid). Een Novel Food Application gaat vergezeld van een dossier met onderzoek naar de mogelijke toxiciteit van het voedingsmiddel in kwestie. Als een nieuw voedingsmiddel veilig wordt geacht voor menselijke consumptie, krijgt het een 'vergunning voor het in de handel brengen'. Dit laat landen weten dat ze kunnen toestaan dat het voedingsmiddel wordt verkocht.<\/p>\n<\/div>\n<\/div>\n\n\n\n

CBD en nieuwe voedingsmiddelen vandaag<\/h2>\n\n\n\n

De Novel Food Guidelines zijn openbaar en kunnen hier worden opgezocht:<\/p>\n\n\n\n

De vermelding voor Cannabis Sativa L. resulteert in een groen vinkje met de tekst: \"(...) delen zoals zaden, zaadolie, hennepzaadmeel, ontvette hennepzaad zijn al eerder in de EU geconsumeerd en zijn daarom niet nieuw.\"<\/em><\/p>\n\n\n\n

Er is echter een aparte vermelding gemaakt voor Cannabino\u00efden met een groot rood kruis en de tekst: (...) producten die cannabino\u00efden bevatten worden beschouwd als nieuwe voedingsmiddelen (...)\".<\/em><\/p>\n\n\n\n

\"\"<\/figure>\n\n\n\n

Deze vermeldingen zijn \"aantoonbaar onjuist\" in de woorden van EIHA (de European Industrial Hemp Association) \"de nieuwe vermelding voor Cannabis Sativa L. maakt geen melding van hennepbladeren en -bloemen. Extracten ontbreken ook, hoewel extractie wordt beschouwd als een traditionele en conventionele methode van voedselverwerking.\"<\/p>\n\n\n\n

EIHA verduidelijkt verder dat \"extracten met een van nature voorkomend niveau van cannabino\u00efden nu zijn uitgesloten, hoewel ze wel werden genoemd in de vorige vermelding. Dergelijke producten waren al voor 1997 in aanzienlijke mate op de markt en geconsumeerd.\"<\/p>\n<\/div>\n<\/div>\n\n\n\n

Goed nieuws: gunstige uitspraak EHJ in Kanavape vs Frankrijk<\/h2>\n\n\n\n

Onlangs is er een uitspraak gedaan door het HvJ (Europees Hof van Justitie, de hoogste rechter in de EU) In Kanavape vs Frankrijk (Zaak C-663\/18) heeft het HvJ geoordeeld dat \"een lidstaat het op de markt brengen van cannabidiol (CBD) niet mag verbieden wanneer dit volledig is ge\u00ebxtraheerd uit de Cannabis Sativa plant.\"<\/p>\n\n\n\n

De uitspraak is opmerkelijk door de hoeveelheid informatie die het geeft over het standpunt van het Europees Hof van Justitie over dit onderwerp. Het bevestigt dat CBD-producten niet verboden kunnen worden in een EU-land als ze legaal te koop zijn in een ander EU-land.<\/p>\n<\/div>\n<\/div>\n\n\n\n

Slecht nieuws: Novel Food-toepassingen komen langzaam tot stilstand<\/h2>\n\n\n\n

De commissaris voor DG Sante, het directoraat-generaal Gezondheid en Voedselveiligheid in de Europese Unie, heeft onlangs gezegd dat er voor eind 2023 geen feedback wordt verwacht over het toxicologisch dossier dat EIHA bij de EFSA heeft ingediend.<\/p>\n\n\n\n

Dit is slecht nieuws, vooral voor alle merken die hebben gewacht op markttoelating via een sublicentie.<\/p>\n<\/div>\n<\/div>\n\n\n\n

Wat nu?<\/h2>\n\n\n\n

Dit alles maakt de status van CBD als voedsel weer onduidelijk. We weten dat het probleem met nieuwe voedselreguleringen uiteindelijk zal verdwijnen, omdat lidstaten gedwongen worden zich aan te passen aan de Kanavape vs Frankrijk uitspraak. We zien echter dat er meer weerstand verwacht kan worden en de anti-cannabis lobby is sterk als altijd.<\/p>\n\n\n\n

In het Verenigd Koninkrijk zijn koudgeperste oli\u00ebn echter expliciet toegestaan en in de ogen van de FSA zijn het geen nieuwe voedingsmiddelen: https:\/\/www.food.gov.uk\/business-guidance\/cannabidiol-cbd<\/a><\/span><\/p>\n\n\n\n

Conclusie<\/h2>\n\n\n\n

CBD en Cannabino\u00efden blijven een Novel Food in de EU, hoewel niet alle lidstaten de richtlijnen volgen. In het Verenigd Koninkrijk is koudgeperste olie toegestaan voor normale verkoop.
