In dit artikel willen we het een en ander zeggen over CBD Legaliteit in Europa, speciaal voor bedrijven. We leggen uit wat de wettelijke definitie van hennep is, wat de Europese regelgeving is, welke soorten als hennep worden geclassificeerd en wat illegale cannabis is. Regelgeving met betrekking tot voedselproductie, farmaceutische producten, biologische landbouw en laboratoriumtests.<\/strong><\/p>\n<\/div>\n<\/div>\n\n\n\n

Wat is de wettelijke definitie van hennep?<\/h2>\n\n\n\n

CBD wordt gewonnen uit hennep, een plant die deel uitmaakt van de Cannabis Sativa familie. In Europa verwijst legale hennep naar een aantal specifieke soorten. Andere woorden die gebruikt worden voor legale hennep zijn: industri\u00eble hennep of landbouwhennep. In deze video gebruik ik het woord 'hennep' om naar deze legale soorten te verwijzen.<\/p>\n\n\n\n

Toen cannabis illegaal werd gemaakt in de eerste helft van de 20e eeuw, werden er een aantal uitzonderingen gemaakt om bepaalde industrie\u00ebn te redden die zonder cannabis niet konden overleven. Deze industrie\u00ebn waren afhankelijk van de zaden en vezels om hun producten te maken. Om een voorbeeld te geven uit de auto-industrie: een typische Mercedes C-klasse bevat ongeveer 20kg hennepvezel.<\/p>\n<\/div>\n<\/div>\n\n\n\n

Hennep bevat minder dan 0,2% THC<\/h2>\n\n\n\n

In Europa heeft de Europese Commissie bepaalde stammen van Cannabis Sativa gekwalificeerd als hennep.
Deze cultivars bevatten niet meer dan 0,2% THC. Als het THC-gehalte in de plant hoger is, worden ze niet langer beschouwd als hennep, maar als niet-vrijgestelde Cannabis. Ondanks de toenemende discussie over legalisatie kunnen straffen voor illegale, commerci\u00eble productie hoge boetes en gevangenisstraffen inhouden.<\/p>\n\n\n\n

Hoewel Zwitserland toestaat dat THC aanwezig is tot 1%, is het handig om in gedachten te houden dat dit land geen deel uitmaakt van de EU en dat elk product dat niet voldoet aan de Europese wetgeving illegaal is binnen de Europese Unie.<\/p>\n<\/div>\n<\/div>\n\n\n\n

64 Rassen van legale cannabis sativa in Europa<\/h2>\n\n\n\n

Ten tijde van het maken van deze video erkent de Europese Commissie in totaal 64 vari\u00ebteiten van cannabis sativa als hennep. Deze zijn te vinden op de website van de Europese Commissie<\/a><\/span>.<\/p>\n\n\n\n

Een paar bekende vari\u00ebteiten voor CBD-productie zijn Carmagnola, Finola, Futura 75 en Uso-31.<\/p>\n\n\n\n

Wat is geclassificeerd als illegale cannabis<\/h2>\n\n\n\n

Onthoud: het is de herkomst van de zaden die de plant kwalificeert als hennep. Als je overweegt om nieuwe genetica te gebruiken die minder dan 0,2% THC hebben maar door de Europese Commissie niet als hennep worden gekwalificeerd, worden ze nog steeds als illegale cannabis beschouwd.<\/p>\n\n\n\n

De soorten op deze lijst mogen in de hele Europese Unie gekweekt worden, hoewel de lidstaten binnen hun grenzen aanvullende regels kunnen opstellen.
Als je overweegt om hennep te gaan kweken, is het belangrijk om te kijken of er aanvullende regels zijn in jouw land, zoals vereiste vergunningen.<\/p>\n<\/div>\n<\/div>\n\n\n\n

Het uiteindelijke gebruik van het gewas is wettelijk belangrijk<\/h2>\n\n\n\n

Het beoogde eindgebruik van het gewas kan ook juridisch van belang zijn, en de teelt voor de productie van CBD-olie is over het algemeen meer gereguleerd dan de teelt van vezelhennep.<\/p>\n\n\n\n

Cannabis Sativa die niet als hennep kan worden aangemerkt, mag in de hele EU niet worden gekweekt, tenzij er een speciale vergunning voor is afgegeven. Deze zijn streng gereguleerd en slechts een handjevol bedrijven is er tot nu toe in geslaagd om ze te bemachtigen. Een van de bekendste is het Nederlandse Bedrocan.<\/p>\n<\/div>\n<\/div>\n\n\n\n

Regelgeving voor CBD als voedingssupplement<\/h2>\n\n\n\n

Als je CBD-producten op de markt brengt als voedingssupplement, houd er dan rekening mee dat je moet voldoen aan de Europese Autoriteit voor Voedselveiligheid. Zij reguleren ook gezondheidsclaims met betrekking tot voedingssupplementen.<\/p>\n\n\n\n

Voor de productie van voedingssupplementen heet het veiligheidsprotocol waar uw bedrijf zich aan moet houden FSSC22000. Dit is een versie van ISO22000 die erkend is door het Global Food Safety Initiative.<\/p>\n<\/div>\n<\/div>\n\n\n\n

Gevarenanalyse en kritische controlepunten<\/h2>\n\n\n\n

Dit protocol omvat HACCP: Hazard Analysis and Critical Control Points (risicoanalyse en kritische controlepunten).
Dit protocol is opgebouwd uit 7 stappen: Uitvoeren van een gevarenanalyse, Identificeren van kritische controlepunten en vaststellen van: kritische grenzen voor elk kritische controlepunt, kritische controlepunt bewakingsvereisten, corrigerende maatregelen, procedures om te garanderen dat het HACCP-systeem werkt zoals bedoeld en procedures voor het bijhouden van gegevens.<\/p>\n\n\n\n

Goede productiepraktijken<\/h2>\n\n\n\n

GMP<\/a><\/span>wat Good Manufacturing Practice betekent, is een systeem om ervoor te zorgen dat producten consistent geproduceerd en gecontroleerd worden. De Europese Unie heeft haar wetgeving geharmoniseerd met de aanbevelingen van de Wereldgezondheidsorganisatie. GMP-certificering is noodzakelijk voor handel met farmaceutische bedrijven.<\/p>\n\n\n\n

Biologische certificering van hennep<\/h2>\n\n\n\n

De Europese Unie heeft ook de praktijken die vereist zijn voor biologische landbouw<\/a><\/span>. Producten die aan deze praktijken voldoen, kunnen worden erkend door de 'EU gecertificeerd biologisch\" logo<\/a><\/span>.<\/p>\n\n\n\n

Laboratoriumtests van CBD-producten<\/h2>\n\n\n\n

Omdat er geen geharmoniseerde wetgeving is voor het testen van CBD-producten op verontreiniging, raden we aan organisch materiaal te gebruiken. Hennep is een bioaccumulator, wat betekent dat het zware metalen uit de aarde haalt en deze opslaat in de bovengrondse delen. Zonder de juiste tests zouden mogelijke verontreinigingen geconcentreerd kunnen worden in het eindproduct.<\/p>\n<\/div>\n<\/div>\n\n\n\n

Legaliteit van CBD in Europa: De CBD-markt is geen grijze zone<\/h2>\n\n\n\n

Bij het navigeren door CBD legaliteit in Europa wordt de markt vaak een grijze zone genoemd, maar dit is een misvatting. Er zijn duidelijke regels, hoewel het niet altijd makkelijk is om ze te vinden omdat ze door een groot aantal Europese instanties worden bepaald. Als je een significante hoeveelheid kapitaal investeren in de productie of distributie van CBD-producten<\/a><\/span>Controleer zorgvuldig welke wetgeving op jouw situatie van toepassing is.<\/p>\n\n\n\n
