Wir verfolgen den Status von CBD in den Leitlinien f\u00fcr neuartige Lebensmittel seit 2013. Es folgten drei verschiedene Eintr\u00e4ge sowie ein Versuch der Europ\u00e4ischen Kommission, CBD wieder als Arzneimittel einzustufen. Eine gute Nachricht kam mit dem Urteil des Europ\u00e4ischen Gerichtshofs (EuGH) im Fall Kanavape<\/strong><\/p>\n\n\n\n

In diesem Artikel geben wir Ihnen einen \u00dcberblick dar\u00fcber, wie die Landschaft aussieht und was unserer Meinung nach als n\u00e4chstes passieren wird.<\/strong><\/p>\n<\/div>\n<\/div>\n\n\n\n

Was sind \"neuartige Lebensmittel\"?<\/h2>\n\n\n\n

Gem\u00e4\u00df der Verordnung (EU) 2015\/2283 ist ein neuartiges Lebensmittel definiert als \"[Lebensmittel, die] vor dem 15. Mai 1997 in der Union nicht in nennenswertem Umfang f\u00fcr den menschlichen Verzehr verwendet wurden (...)\"<\/em>. <\/p>\n\n\n\n

Das bedeutet, dass ein Unternehmen, das ein neues Produkt auf den Markt bringen will, zun\u00e4chst dessen Unbedenklichkeit f\u00fcr den menschlichen Verzehr nachweisen muss. Dies geschieht \u00fcber einen Antrag auf Zulassung eines neuartigen Lebensmittels bei der EFSA (Europ\u00e4ische Beh\u00f6rde f\u00fcr Lebensmittelsicherheit). Einem Antrag auf ein neuartiges Lebensmittel liegt ein Dossier bei, das Untersuchungen \u00fcber die m\u00f6gliche Toxizit\u00e4t des betreffenden Lebensmittels enth\u00e4lt. Wird ein neuartiges Lebensmittel als sicher f\u00fcr den menschlichen Verzehr eingestuft, erh\u00e4lt es eine \"Zulassung vor dem Inverkehrbringen\". Damit wissen die L\u00e4nder, dass sie den Verkauf des Lebensmittels zulassen k\u00f6nnen.<\/p>\n<\/div>\n<\/div>\n\n\n\n

CBD und Novel Food heute<\/h2>\n\n\n\n

Die Leitlinien f\u00fcr neuartige Lebensmittel sind \u00f6ffentlich und k\u00f6nnen hier eingesehen werden:<\/p>\n\n\n\n

Der Eintrag f\u00fcr Cannabis Sativa L. ergibt ein gr\u00fcnes H\u00e4kchen mit dem Text: \"(...) Teile wie Samen, Samen\u00f6l, Hanfsamenmehl und entfettete Hanfsamen werden in der EU schon lange konsumiert und sind daher nicht neu.\"<\/em><\/p>\n\n\n\n

F\u00fcr Cannabinoide wurde jedoch eine eigene Liste mit einem gro\u00dfen roten Kreuz und dem Text erstellt: '(...) Produkte, die Cannabinoide enthalten, gelten als neuartige Lebensmittel (...)'<\/em><\/p>\n\n\n\n

\"\"<\/figure>\n\n\n\n

Diese Eintr\u00e4ge sind nach den Worten der EIHA (European Industrial Hemp Association) \"nachweislich falsch\": \"Der neue Eintrag f\u00fcr Cannabis Sativa L. erw\u00e4hnt keine Hanfbl\u00e4tter und -bl\u00fcten. Auch Extrakte fehlen, obwohl die Extraktion als eine traditionelle und konventionelle Methode der Lebensmittelverarbeitung gilt\".<\/p>\n\n\n\n

Die EIHA stellt weiter klar, dass \"Extrakte mit einem nat\u00fcrlich vorkommenden Gehalt an Cannabinoiden nun ausgeschlossen sind, obwohl sie in der vorherigen Eintragsformulierung erw\u00e4hnt wurden. Solche Produkte waren bereits vor 1997 auf dem Markt und wurden in erheblichem Umfang konsumiert\".<\/p>\n<\/div>\n<\/div>\n\n\n\n

Gute Nachrichten: Positives EuGH-Urteil im Fall Kanavape gegen Frankreich<\/h2>\n\n\n\n

In der Rechtssache Kanavape gegen Frankreich (Rechtssache C-663\/18) hat der EuGH entschieden, dass \"ein Mitgliedstaat das Inverkehrbringen von Cannabidiol (CBD) nicht verbieten darf, wenn es aus der Cannabis-Sativa-Pflanze in ihrer Gesamtheit extrahiert wird\".<\/p>\n\n\n\n

Das Urteil ist insofern bemerkenswert, als es viele Informationen \u00fcber die Position des EuGH zu diesem Thema liefert. Es best\u00e4tigt, dass der Verkauf von CBD-Produkten in einem EU-Land nicht verboten werden kann, wenn sie in einem anderen EU-Land legal verkauft werden d\u00fcrfen.<\/p>\n<\/div>\n<\/div>\n\n\n\n

Schlechte Nachrichten: Anwendungen f\u00fcr neuartige Lebensmittel kommen langsam zum Stillstand<\/h2>\n\n\n\n

Der Kommissar der Generaldirektion Gesundheit und Lebensmittelsicherheit in der Europ\u00e4ischen Union, GD Sante, hat k\u00fcrzlich erw\u00e4hnt, dass vor Ende 2023 keine R\u00fcckmeldung zu dem von der EIHA bei der EFSA eingereichten Toxikologie-Dossier zu erwarten ist.<\/p>\n\n\n\n

Dies ist eine schlechte Nachricht, insbesondere f\u00fcr alle Marken, die darauf gewartet haben, durch eine Unterlizenz eine Marktzulassung zu erhalten.<\/p>\n<\/div>\n<\/div>\n\n\n\n

Und wie geht es weiter?<\/h2>\n\n\n\n

All dies l\u00e4sst den Status von CBD als Lebensmittel erneut im Unklaren. Wir wissen, dass das Problem mit der Regulierung neuartiger Lebensmittel irgendwann verschwinden wird, da die Mitgliedsstaaten gezwungen sind, sich an das Urteil Kanavape gegen Frankreich anzupassen. Wir sehen jedoch, dass mehr Widerstand zu erwarten ist, und die Anti-Cannabis-Lobby ist stark wie eh und je.<\/p>\n\n\n\n

Im Vereinigten K\u00f6nigreich sind kaltgepresste \u00d6le jedoch ausdr\u00fccklich zugelassen und gelten in den Augen der FSA nicht als neuartige Lebensmittel: https:\/\/www.food.gov.uk\/business-guidance\/cannabidiol-cbd<\/a><\/span><\/p>\n\n\n\n

Schlussfolgerung<\/h2>\n\n\n\n

CBD und Cannabinoide bleiben in der EU ein Novel Food, auch wenn nicht alle Mitgliedsstaaten den Richtlinien folgen. Im Vereinigten K\u00f6nigreich ist kaltgepresstes \u00d6l f\u00fcr den normalen Verkauf zugelassen. Die bevorstehende Legalisierung von Cannabis in Deutschland k\u00f6nnte Vorteile f\u00fcr den gesamten EU-Markt bringen.<\/p>\n<\/div>\n<\/div>","protected":false},"excerpt":{"rendered":"
