Demnach haben sich die Bundesregierung und das Bundesministerium f\u00fcr Ern\u00e4hrung und Landwirtschaft (BMEL) klar der Auffassung der EIHA angeschlossen: Lebensmittel, die Teile der Hanfpflanze enthalten, sind grunds\u00e4tzlich keine \"neuartigen\" Lebensmittel im Sinne der Verordnung (EU) 2015\/2283. Dies gilt jedoch nicht automatisch auch f\u00fcr isoliertes CBD (Cannabidiol) oder mit CBD angereicherte Extrakte. \"Hanf-Lebensmittel aus traditionell hergestellten Extrakten mit dem nat\u00fcrlichen Vollspektrum der in der Hanfpflanze enthaltenen Cannabinoide sind also keine neuartigen Lebensmittel. F\u00fcr die deutsche Hanflebensmittelindustrie ist diese Aussage der Regierung und des Ministeriums ein wichtiger Meilenstein\", sagt Daniel Kruse, Pr\u00e4sident der EIHA.<\/p>\n\n\n\n<p>Zum Hintergrund siehe unser <span style=\"text-decoration: underline;\"><a href=\"https:\/\/cbdoileurope.com\/de\/cbd-legality\/novel-foods-cannabidiol-cannabinoids-hemp-extracts-debate\/\" target=\"_blank\" data-type=\"link\" data-id=\"https:\/\/cbdoileurope.com\/cbd-legality\/novel-foods-cannabidiol-cannabinoids-hemp-extracts-debate\/\" rel=\"noreferrer noopener\">fr\u00fcherer Artikel \u00fcber neuartige Lebensmittel<\/a><\/span>.<\/p>\n\n\n\n<p>Ausgel\u00f6st wurde die Kontroverse durch eine Ver\u00f6ffentlichung des Bundesamtes f\u00fcr Verbraucherschutz und Lebensmittelsicherheit (BVL) auf seiner Homepage zum Thema \"Nahrungserg\u00e4nzungsmittel mit Cannabidiol (CBD)\" vom 20.03.2019 (Quelle: www.bvl.bund.de):<\/p>\n\n\n\n<p>\"Dem BVL ist derzeit kein Fall bekannt, in dem Cannabidiol (CBD) in Lebensmitteln, also auch in Nahrungserg\u00e4nzungsmitteln, vorkommen k\u00f6nnte.\"<\/p>\n\n\n\n<p>Das BVL wird weiterhin Informationen auf seiner Homepage an anderer Stelle ver\u00f6ffentlichen:<\/p>\n\n\n\n<p>\"Nach Auffassung des BVL muss f\u00fcr CBD-haltige Produkte entweder ein Antrag auf Zulassung eines Arzneimittels oder ein Antrag auf Zulassung eines neuartigen Lebensmittels gestellt werden, bevor die Produkte in Verkehr gebracht werden. Im Rahmen dieser Verfahren ist die Unbedenklichkeit des Produktes durch den Antragsteller nachzuweisen.\"<\/p>\n\n\n\n<p>Das EIHA h\u00e4lt die oben genannte pauschale Einsch\u00e4tzung des BVL zur angeblich fehlenden Verkehrsf\u00e4higkeit von CBD-haltigen Nahrungserg\u00e4nzungsmitteln f\u00fcr sachlich und rechtlich falsch und unzutreffend. Aus Sicht der EIHA w\u00fcrde diese Einsch\u00e4tzung des BVL bedeuten, dass alle Hanf-Lebensmittel unter die Novel-Food-Verordnung fallen und damit zulassungspflichtig w\u00e4ren.<\/p>\n\n\n\n<p>\"Das ist so nicht richtig. CBD ist ein v\u00f6llig nat\u00fcrlicher, nicht psychotischer Inhaltsstoff des Industriehanfs und wird seit Jahrtausenden \u00fcber die Hanfsamen, -bl\u00fcten und -bl\u00e4tter konsumiert und zu hochwertigen Lebensmitteln verarbeitet, auch durch traditionelle Extraktionsverfahren\", sagt EIHA-Pr\u00e4sident Kruse. \"Das BVL muss unterscheiden zwischen Extrakten mit dem nat\u00fcrlichen Vollspektrum der in der Hanfpflanze enthaltenen Cannabinoide einerseits und Produkten, die mit Isolaten oder mit Cannabinoiden angereichert sind, andererseits.
