Bei neuartigen Lebensmitteln kann es sich um neu entwickelte, innovative Lebensmittel, um Lebensmittel, die mit neuen Technologien und Produktionsverfahren hergestellt werden, und um Lebensmittel handeln, die traditionell au\u00dferhalb der EU verzehrt werden. Die Verordnung schreibt unter anderem vor, dass solche Lebensmittel sicher sind und ordnungsgem\u00e4\u00df gekennzeichnet werden m\u00fcssen, um die Verbraucher nicht zu t\u00e4uschen. Das Ergebnis f\u00fcr die Lebensmittelhersteller ist ein aufw\u00e4ndigerer Markt, da neuartige Lebensmittel strenge und kostspielige Zulassungsanforderungen erf\u00fcllen m\u00fcssen.<\/p>\n\n\n\n<p>Hanfbl\u00fctenprodukte wie Hanfsamen und Hanfsamen\u00f6l (-extrakt) sind nach den EU-Vorschriften zugelassene neuartige Lebensmittel, die aufgrund des nachgewiesenen Verbrauchs in den Mitgliedstaaten vor Mai 1997 von der Registrierung ausgenommen sind.<\/p>\n\n\n\n<p>Die j\u00fcngsten sprachlichen \u00c4nderungen des Katalogs f\u00fcr neuartige Lebensmittel besagen jedoch, dass \"Extrakte aus Cannabis sativa L. und daraus hergestellte Produkte, die Cannabinoide, einschlie\u00dflich Cannabidiol (CBD), enthalten, als neuartige Lebensmittel gelten, da ein historischer Konsum nicht nachgewiesen wurde.\"<\/p>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-28f84493 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<h2 class=\"wp-block-heading\">Die Beweise der EIHA<\/h2>\n\n\n\n<p>W\u00e4hrend der Sitzung am 12. M\u00e4rz widerlegte die EIHA jedoch dieses Argument und zitierte zun\u00e4chst eine von der EU-Kommission in Auftrag gegebene Studie des Nova-Instituts (1997), in der 23 Unternehmen aus ganz Europa angaben, vor 1997 insgesamt mehr als 255 Tonnen Lebensmittel auf Hanfbasis produziert zu haben. (Schwerpunkt: Cannabidiol)<\/h2>\n\n\n\n<p>Definition von Hanfextrakten: von lateinisch \"extrahere\" = herausziehen, entfernen) ist jedes Verfahren, das ein (festes, fl\u00fcssiges oder gasf\u00f6rmiges) Extraktionsmittel verwendet, um einen oder mehrere Bestandteile aus einem Stoffgemisch (aus festen, fl\u00fcssigen oder gasf\u00f6rmigen Stoffen) zu entfernen<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Kaffee &gt; Kaffee-Extrakt \/ Tee &gt; Tee-Extrakt<\/li>\n<\/ul>\n\n\n\n<p>Cannabidiol (CBD) ist das am h\u00e4ufigsten vorkommende Cannabinoid, das nat\u00fcrlich in der Nutzhanfpflanze und ihren Extrakten vorkommt. Es ist nicht psychotrop, nicht berauschend, nicht s\u00fcchtig machend und wird vom Menschen auch in hohen Dosen sehr gut vertragen<\/p>\n\n\n\n<p>Hanfextrakte werden wegen ihrer gesundheitsf\u00f6rdernden Eigenschaften in Nahrungsmitteln und Nahrungserg\u00e4nzungsmitteln verwendet.<\/p>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-28f84493 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<h2 class=\"wp-block-heading\">Wie werden Hanfextrakte aus der Hanfpflanze hergestellt?<\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Kaltes Pressen:<\/strong> der einfachste Extrakt aus den Hanffr\u00fcchten ist das Hanfsamen\u00f6l<\/li>\n\n\n\n<li><strong>Ethanol-Extraktion:<\/strong> Verwendung von Alkohol f\u00fcr ganze Fruchtspitzen (Infructescense) und Bl\u00e4tter<\/li>\n\n\n\n<li><strong>CO2-Extraktion:<\/strong> Verwendung von Kohlendioxid f\u00fcr ganze Fruchtst\u00e4nde (Infrukteszenzen) und Bl\u00e4tter<\/li>\n\n\n\n<li><strong>Fettextraktion:<\/strong> kann leicht f\u00fcr hausgemachte Zubereitungen verwendet werden<\/li>\n<\/ol>\n\n\n\n<p>Der Extrakt kann roh belassen oder decarboxyliert und ohne weitere Verarbeitung den Verbraucherprodukten zugesetzt werden.<\/p>\n\n\n\n<p>Die Extrakte werden in der Regel \u00fcberwintert, um die Pflanzenwachse zu entfernen.<\/p>\n\n\n\n<p>Der Extrakt kann weiter destilliert\/rektifiziert werden, um unerw\u00fcnschte Bestandteile wie Chlorophyll zu entfernen.<\/p>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-28f84493 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<h2 class=\"wp-block-heading\">Novel Food Katalog letzte \u00c4nderung:<\/h2>\n\n\n\n<p>Am 20. Januar 2019 einigten sich die Mitgliedstaaten und die Kommission auf einen neuen Wortlaut f\u00fcr den Katalog der neuartigen Lebensmittel.<\/p>\n\n\n\n<p>Im Artikel <strong>Cannabis sativa L:<\/strong><\/p>\n\n\n\n<p>Hanfsamen und ihre Derivate werden nicht als neuartige Lebensmittel bewertet.<br>Bl\u00e4tter und Fruchtst\u00e4nde bleiben in einer Grauzone<\/p>\n\n\n\n<p>Au\u00dferdem wurde ein neuer Punkt \"<strong>Cannabinoide<\/strong>\" wurde in den Novel Food Katalog aufgenommen.<br>Hanfextrakte gelten als Novel Food<\/p>\n\n\n\n<p><strong>Schlussfolgerung:<\/strong> gro\u00dfe Verwirrung hinsichtlich der Auslegungen und negative Auswirkungen auf den Hanfsektor (in Bezug auf Investitionen und gleiche Wettbewerbsbedingungen)<\/p>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-28f84493 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<h2 class=\"wp-block-heading\">EIHA demonstrierte bereits im Oktober 2018<\/h2>\n\n\n\n<p>Lebensmittelunternehmer in der EU haben in gutem Glauben auf der Grundlage der im Novel Food Catalogue \u00e0Investitionen enthaltenen Informationen gehandelt.<\/p>\n\n\n\n<p>Die Verwendung von Hanfbl\u00e4ttern und -fr\u00fcchten wurde in der Auflistung f\u00fcr den Artikel Cannabis sativa NICHT unterschieden.<\/p>\n\n\n\n<p>Der Katalogartikel Cannabidiol hat eine klare Vorgabe gemacht: Produkte mit \"nat\u00fcrlichem\" CBD-Gehalt wurden als \"traditionell\" eingestuft.<\/p>\n\n\n\n<p>F\u00fcr die Aufbereitung von Hanf-Infructescense werden ausschlie\u00dflich traditionelle Vermehrungsmethoden angewandt.<\/p>\n\n\n\n<p>Zu diesen Verfahren geh\u00f6ren das Pressen oder die L\u00f6sungsmittelextraktion.<\/p>\n\n\n\n<p>Das Vorhandensein von Cannabinoiden in der menschlichen Ern\u00e4hrung ist auch im Mittelalter und in der Neuzeit gut dokumentiert. Dezember 2015 \u00fcber Gew\u00fcrze, Speisesalz, dehydrierte Lebensmittel, Suppenzubereitungen und \u00fcber Aromen enth\u00e4lt in Anhang III, Tabelle 1 den Artikel konopa siata - Cannabis sativa L. - Blatt, Samen:<br>VERZEICHNIS VON PFLANZEN UND IHREN TEILEN, DIE F\u00dcR DIE HERSTELLUNG VON TEE GEEIGNET SIND, ohne eine Beschr\u00e4nkung der verwendeten Menge [des Krauts] zu empfehlen.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\">\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-28f84493 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<h2 class=\"wp-block-heading\">Standpunkt der EIHA zu Hanfextrakten<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Bl\u00e4tter und Bl\u00fcten der Industriehanfpflanze sind nicht NF -&gt;reguliert wie Lebensmittel und Nahrungserg\u00e4nzungsmittel (Vorschriften und Kennzeichnung)<\/li>\n\n\n\n<li>Extrakte aus Hanfpflanzen, die in der EU legal angebaut werden, sind keine nationalen Vorschriften.<\/li>\n\n\n\n<li>Nat\u00fcrlich vorkommende Cannabinoide in den Extrakten der ganzen Pflanze sind keine NE<\/li>\n\n\n\n<li>Aus Gr\u00fcnden der Verbrauchersicherheit schl\u00e4gt die EIHA eine maximale Tagesdosis von 160 mg (f\u00fcr einen durchschnittlichen Erwachsenen) f\u00fcr Lebensmittel und Nahrungserg\u00e4nzungsmittel vor.<\/li>\n\n\n\n<li>Gentechnisch ver\u00e4nderte Pflanzen und synthetisches Material sind NF<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Weitere \u00dcberlegungen<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Hanfbl\u00fctenprodukte wie Hanfsamen und ihr Extrakt - Hanf\u00f6l - sind traditionelle Lebensmittel, die aufgrund des nachgewiesenen Verbrauchs in den Mitgliedstaaten vor Mai 1997 von der Zulassung als neuartige Lebensmittel ausgenommen sind.<\/li>\n\n\n\n<li>Ein nat\u00fcrlicher Nebeneffekt der langen Geschichte des Konsums von Hanfsamen ist ein klebriges Harz, das sich auf der Au\u00dfenseite der Samenschale befindet -&gt; Cannabinoide befinden sich in diesem Harz.<\/li>\n\n\n\n<li>Cannabinoide finden sich als R\u00fcckst\u00e4nde auf Samen und anderen Pflanzenteilen (die keine NE sind) und werden daher ohne Genehmigung konsumiert.<\/li>\n\n\n\n<li>Beim Pressen kann das Hanfsamen\u00f6l mit anderen Bestandteilen der Fruchtst\u00e4nde der Pflanze, die Cannabinoide enthalten, verunreinigt werden, was dazu f\u00fchrt, dass Cannabinoide im Hanfsamen\u00f6l vorhanden sind.<\/li>\n\n\n\n<li>In der Vergangenheit, bis zum Beginn des 20. Jahrhunderts, als die mechanischen Dreschmaschinen eingef\u00fchrt wurden, wurden alle Samen - ob Weizenk\u00f6rner oder Hanfsamen - beim manuellen Dreschen mit Dreschflegeln gewonnen. Das unvermeidliche Vorhandensein einer solchen Kombination, aus der das \u00d6l gepresst wurde, f\u00fchrt zu einem \u00fcberh\u00f6hten Gehalt an Cannabinoiden im Hanfsamen\u00f6l.<\/li>\n\n\n\n<li>Im vorindustriellen Zeitalter war das auf diese Weise gewonnene Hanfsamen\u00f6l die wichtigste Quelle f\u00fcr Pflanzen\u00f6l in der menschlichen Ern\u00e4hrung, so dass Cannabinoide in gr\u00f6\u00dferen Mengen als heute konsumiert wurden und es eine lange Geschichte des Konsums vor 1997 gibt<\/li>\n\n\n\n<li>Die Teile, aus denen das Ganze besteht, sind untrennbar mit dem Ganzen verbunden; wenn das Ganze ausgenommen ist, sind es auch die Teile.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Weitere \u00dcberlegungen<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Man muss auch bedenken, dass Hanf und Hopfen zur gleichen Pflanzenfamilie der Cannabaceae geh\u00f6ren, die etwa 170 Arten umfasst, die in etwa 11 Gattungen unterteilt sind, darunter Cannabis (Hanf, Marihuana), Humulus (Hopfen) und Celtis (Heidelbeeren).
